Terms of Service
The expressions used within this document shall have the following meanings:
" Artist" means a person who has stated that they have the skills required for the Service
"Applicant" means the Artist who has applied for service via an Application, or referred to as "you"
"Application" is the submission of details by the Applicant requesting the service for a Fee
"Service" means the services and facilities that we provide, including but not limited to, photographic, video and audio recording - services provided during an engagement;
"Service Provider" means the organisation or individuals providing the Service, referred to as "we" or "us" or "our" .
"Engagement" means the Service to be used by of the Applicant on a short-term basis under any form of contract or relevant agreement;
" Fee" means the monies due to the Service Provider for the Engagement.
1. Applications
When the Applicant submits an Application, the Applicant agrees that :-
1.1 The Applicant has read and understood the requirements for the Service;
1.2 The information that the Applicant provides as part of the Application (including, without limitation, in any CV) is a true and accurate reflection of the Applicant’s employment, education, experience,appearance, measurements, age, description, and training and that the Applicant's personal details are correct.
1.3 Any and all images and information provided in (1.2) are recent, produced within 3 months of the date of the Application.
1.4 If the Applicant submits any information in an Application that is found to be false, the Serviec Provider reserve the right to deny the Applicant our Service.
1.5 Applicants should note that Applications are assessed by a member of our staff and all decisions relating to such Applications are taken by the relevant member of our staff . Accordingly, any requests for information relating to Applications that have been made should be addressed to themember of our staff directly, whose name appears on any correspondence with you.
1.6 An Applicant is deemed to have read and accepted these terms and conditions by placing a tick in the check box on the Application Form and submitting an Application.
1.7 An Application in no way guarantees Engagement of the Applicant.
2.Payment / Refunds
2.1 These Terms constitute a contract for services between the Service Provider and the Applicant used for the Engagement . However, no written or verbal contract shall exist between the Service Provider and the Applicant used for the Engagement.
2.2. For the avoidance of doubt, these Terms shall not give rise to a contract of employment between the Service Provider and the Applicant used for the Engagement.
The Applicant or their representative shall pay to the Service Provider an Engagement remuneration specified for the Engagement . The actual rate will be notified in written or verbal form on a per Assignment basis, to be paid on completion.
2.3. The Applicant used for the Engagement is not entitled to receive payment from the Service Provider,
2.4. Refund in full will be paid if the Engagement is not fulfilled by the service provider.
3. Indemnity
3.1 The Applicant agree to release, indemnify and keep us indemnified from and against all actions, claims, costs (including legal costs and expenses) losses, proceedings, damages, liabilities, or demands suffered or incurred by us to any person arising out of or in connection with your use of our services.
4. Disputes
These terms and the other policies posted on LazerMedia constitute the entire agreement between LazerMedia and you, superceding any prior agreements. No agency, partnership, joint venture, employee-employer or franchiser-franchisee relationship is intended or created by this Agreement.
The Engagement shall be governed and construed in all respects by the laws of England and Wales. You agree that any claim or dispute you mayhave against LazerMedia must be resolved by the courts of England and Wales. You and LazerMedia Ltd both agree to submit to the exclusive jurisdiction of the English Courts; for claims falling within the jurisdiction of a County Court, you and LazerMedia both agree to submit to the jurisdiction of the County Court of LazerMedia schoosing.
If LazerMedia does not enforce any particular provision, we are not waiving our right to do so later. If a court strikes down any of these terms, the remaining terms will survive. We may automatically assign this agreement in our sole discretion in accordance with the notice provision below.
Except for notices relating to illegal or infringing content, your notices to us must be sent by registered mail to the trading premises of LazerMedia, Middle Hillgate, Stockport SK1 3AY
We may update this agreement at any time.
